These Terms of Service govern your access to and use of belleneuve.com and any purchases made through the website.

The website and online store are operated by North Duo Oy under the Belleneuve brand. Throughout these Terms, “Belleneuve,” “we,” “us,” and “our” refer to North Duo Oy.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services.

By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms of Service and any policies referenced within them. If you do not agree to these Terms, you must not use the website or purchase products through it.

1. Eligibility

You must be at least the age of legal majority in your state or place of residence to use the Services independently.

If you are under the age of legal majority, you may use the Services only with the involvement and permission of a parent or legal guardian.

By using the Services, you represent that you have the legal capacity and authority to enter into these Terms.

2. Online store terms

You may not use our products or Services for any unlawful, fraudulent, abusive, or unauthorized purpose.

You may not violate any applicable law while using the Services, including intellectual-property, consumer-protection, privacy, export-control, or cybersecurity laws.

You must not transmit viruses, malicious code, destructive software, or other material intended to interfere with the website, Shopify, or any connected system.

A violation of these Terms may result in the suspension or termination of your access to the Services.

3. Products and availability

We make reasonable efforts to display and describe our products accurately.

Product colors and appearance may vary slightly depending on:

  • Screen settings

  • Lighting

  • Photography

  • Production batches

  • Materials

  • Manufacturing processes

Product measurements and sizing information are approximate and are provided as guidance. Customers are responsible for reviewing the applicable product description and size information before placing an order.

Products may be available only in limited quantities. We may modify, discontinue, or limit the availability of any product without prior notice.

We do not guarantee that all products, sizes, colors, or variations will remain available.

4. Prices and currency

Unless otherwise stated, prices displayed on the website are shown in United States dollars.

Prices may change without prior notice. A price change does not affect an order that has already been accepted, except where the displayed price resulted from an obvious error.

Applicable taxes may be calculated and displayed during checkout based on the order and delivery destination.

Belleneuve provides free standard shipping on eligible orders delivered within our supported United States shipping area, as explained in our Shipping Policy.

5. Orders

Submitting an order constitutes an offer to purchase the products included in the order.

After you place an order, you may receive an automated order-confirmation email. This email confirms that we received the order but does not necessarily mean that the order has been accepted or shipped.

We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Incorrect pricing or product information

  • Suspected fraud or unauthorized payment activity

  • Payment failure

  • Shipping restrictions

  • Duplicate or unusually large orders

  • Misuse of discounts or promotional offers

  • Violation of these Terms

  • An inability to fulfill the order

If we cancel an order after payment has been collected, we will issue a refund to the original payment method.

We may limit or prohibit orders that appear to be placed by resellers, distributors, or other commercial purchasers without our authorization.

6. Customer information

You agree to provide current, complete, and accurate information when placing an order or creating an account.

This includes accurate:

  • Email address

  • Billing information

  • Shipping address

  • Telephone number

  • Payment information

You are responsible for reviewing your order and delivery information before completing checkout.

Belleneuve is not responsible for delays, losses, or failed deliveries caused by incomplete or incorrect information provided by the customer.

7. Payments

Payment must be successfully authorized before an order can be fulfilled.

Payments are processed through Shopify and applicable third-party payment providers. Belleneuve does not generally receive or directly store complete payment-card information.

You represent that:

  • You are authorized to use the payment method provided

  • The payment information is accurate

  • The transaction does not violate applicable law

  • Sufficient funds or credit are available to complete the purchase

We may cancel or delay an order if payment cannot be verified or if the transaction is identified as potentially fraudulent.

8. Shipping and delivery

Belleneuve currently delivers to supported addresses within all 50 United States, including Alaska and Hawaii.

Orders may be fulfilled from warehouses located in the United States or Asia.

Estimated processing and delivery times are described in our Shipping Policy. Delivery dates are estimates and are not guaranteed.

Shipping delays may occur because of carrier operations, customs processing, severe weather, transportation disruptions, seasonal demand, address problems, or other circumstances outside our reasonable control.

Tracking information is provided for all orders when it becomes available.

The customer is responsible for monitoring tracking information and ensuring that the delivery location is safe and accessible.

9. Returns, refunds, and exchanges

Eligible products may be returned in accordance with our Return and Refund Policy.

Belleneuve currently offers a 14-calendar-day return period beginning on the date the eligible product is delivered.

For voluntary returns caused by a change of mind, incorrect size selection, or an unwanted product, the customer is responsible for arranging and paying for return shipping.

We do not charge a restocking fee.

We do not offer direct exchanges. Customers who want another product, size, or color must return the original eligible product and place a new order separately.

Damaged, defective, or incorrect products are handled according to our Return and Refund Policy.

Our Return and Refund Policy forms part of these Terms of Service.

10. Order cancellations

You may request an order cancellation by contacting support@belleneuve.com immediately after placing the order.

We will attempt to accommodate the request, but cancellation cannot be guaranteed after processing or fulfillment has begun.

If the order has already been processed or shipped, it must be handled under our Return and Refund Policy.

11. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions displayed at the time of the offer.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash

  • Only one discount code may be used per order

  • Discounts cannot be applied retroactively

  • Discounts may not apply to every product

  • Expired discount codes will not be accepted

  • Discount codes may not be reproduced, transferred, sold, or used fraudulently

We may modify, suspend, or cancel a promotion where permitted by law.

We may cancel an order or remove a discount if we reasonably determine that a promotion has been misused.

12. Customer accounts

Certain website features may allow you to create a customer account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • Restricting access to your account

  • Ensuring that account information remains accurate

  • Activity conducted through your account

Notify support@belleneuve.com promptly if you believe your account has been accessed or used without authorization.

We may suspend or terminate an account where reasonably necessary to protect the customer, Belleneuve, Shopify, or another party.

13. Reviews and submitted content

You may be able to submit product reviews, photographs, feedback, comments, suggestions, or other content.

You retain ownership of content you submit. However, by submitting content to Belleneuve, you grant North Duo Oy a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, display, and distribute that content for operating, improving, and promoting Belleneuve.

You represent that:

  • You own the submitted content or have permission to use it

  • The content is accurate and based on your genuine experience

  • The content does not infringe another person’s rights

  • The content is not unlawful, misleading, threatening, defamatory, obscene, or malicious

  • The content does not contain malware, spam, or unauthorized advertising

  • The content does not disclose another person’s private information without permission

We may moderate, reject, edit, or remove submitted content where permitted by law.

We are not required to maintain, publish, compensate, or respond to submitted content.

Our use of personal information associated with submitted content is governed by our Privacy Policy.

14. Intellectual property

The website and its contents are owned by or licensed to North Duo Oy and are protected by applicable intellectual-property laws.

Protected content may include:

  • The Belleneuve name and branding

  • Logos

  • Website design

  • Product photographs

  • Graphics

  • Videos

  • Written copy

  • Product descriptions

  • Page layouts

  • Software

  • Icons

  • Other website materials

You may access the website for personal, non-commercial shopping purposes.

You may not reproduce, distribute, modify, publish, sell, license, scrape, reverse engineer, or commercially exploit website content without prior written permission from North Duo Oy or the applicable rights holder.

No use of the Services grants you ownership of any Belleneuve or third-party intellectual property.

15. Prohibited activities

You may not use the Services to:

  • Violate applicable law

  • Infringe intellectual-property or privacy rights

  • Submit false, misleading, or fraudulent information

  • Impersonate another person or organization

  • Conduct payment fraud or chargeback abuse

  • Collect or track another person’s personal information without authorization

17. Shopify

Our store is hosted by Shopify.

Your use of certain checkout, payment, account, privacy, and ecommerce features may also be subject to Shopify’s applicable terms and policies.

Shopify is not responsible for products sold by Belleneuve. North Duo Oy remains responsible for operating Belleneuve, fulfilling customer orders, and handling customer-service matters relating to our products.

18. Errors and inaccuracies

The website may occasionally contain:

  • Typographical errors

  • Incorrect prices

  • Inaccurate product descriptions

  • Incorrect availability information

  • Incorrect promotional details

  • Other omissions or errors

We reserve the right to correct errors, update information, or cancel affected orders where permitted by law.

If an order is cancelled because of an error after payment has been collected, we will refund the affected amount to the original payment method.

We do not guarantee that the website or any feature will always be uninterrupted, timely, secure, or error-free.

We may modify, suspend, restrict, or discontinue part or all of the Services for maintenance, security, operational, legal, or business reasons.

We are not responsible for temporary website unavailability caused by Shopify, hosting providers, internet-service providers, cyberattacks, maintenance, or other circumstances outside our reasonable control.

20. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Services are provided on an “as available” basis.

Except for warranties expressly stated by Belleneuve or warranties that cannot legally be excluded, we do not make additional representations or warranties regarding:

  • Continuous website availability

  • Error-free operation

  • Compatibility with every device or browser

  • The accuracy of third-party content

  • Results obtained through use of the website

Nothing in these Terms excludes or limits any warranty, guarantee, or consumer right that cannot lawfully be excluded.

21. Limitation of liability

To the maximum extent permitted by applicable law, North Duo Oy and its directors, officers, employees, contractors, agents, affiliates, suppliers, fulfillment partners, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the Services or products purchased through the Services.

This may include loss of profits, revenue, savings, data, opportunity, or goodwill.

Where liability cannot be excluded entirely, our total liability arising from a particular order will not exceed the amount paid by the customer for the product or order giving rise to the claim, except where a different limitation is required by law.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law, including liability for fraud, willful misconduct, or personal injury caused by negligence where such liability cannot legally be limited.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold North Duo Oy harmless from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful use of the Services

  • Your material violation of these Terms

  • Your infringement of another party’s rights

  • Content you submit through the Services

This section does not apply to the extent that a claim was caused by Belleneuve’s own unlawful conduct, negligence, or breach of these Terms.

23. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using the Services, you acknowledge that personal information may be processed by North Duo Oy, Shopify, payment providers, fulfillment partners, shipping carriers, and other service providers as described in that policy.

24. Termination

These Terms remain effective until terminated by you or Belleneuve.

You may stop using the Services at any time.

We may suspend or terminate your access if we reasonably believe that you have:

  • Materially violated these Terms

  • Used the Services unlawfully or fraudulently

  • Threatened the security or operation of the Services

  • Caused harm to Belleneuve, another customer, or a third party

Termination does not affect rights or obligations that arose before termination, including payment obligations, intellectual-property rights, limitations of liability, or dispute provisions.

25. Governing law and disputes

These Terms and any separate agreement through which Belleneuve provides Services are governed by the laws of Finland, without regard to conflict-of-law principles.

This governing-law clause does not deprive consumers of any mandatory protections provided by the laws that apply to them and cannot legally be waived by contract.

Disputes should first be submitted to support@belleneuve.com so that we have a reasonable opportunity to resolve the issue directly.

If a dispute cannot be resolved informally, it may be submitted to a court with competent jurisdiction. Nothing in these Terms prevents a consumer from bringing a claim in another court where applicable law grants that right.

26. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted or removed where necessary.

The remaining provisions will continue in full force and effect.

27. No waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

A waiver is effective only if it is provided in writing by an authorized representative of North Duo Oy.

28. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

North Duo Oy may transfer or assign its rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, or transfer of the Belleneuve business, subject to applicable law.

29. Entire agreement

These Terms, together with the policies and notices referenced within them, constitute the entire agreement between you and North Duo Oy regarding use of the Services.

They replace prior or contemporaneous communications relating to the same subject matter.

Any ambiguity in these Terms will not automatically be interpreted against either party solely because that party drafted the wording.

30. Changes to these Terms

We may update these Terms from time to time to reflect changes to:

  • The Services

  • Our business practices

  • Shopify features

  • Applicable laws or regulations

  • Security or operational requirements

The revised Terms will be published on this website with an updated “Last updated” date.

Changes apply prospectively from the date they are published unless applicable law requires otherwise.

Your continued use of the Services after revised Terms take effect constitutes acceptance of the revised Terms.
